WAIVER AND RELEASE OF LIABILITY

 

EVENT INFORMATION:

 

Name of Event: The Sleeved Dietitian In-Person Fall Meet-Up

 

Date of Event: Saturday, October 11, 2025, 11:30 AM to 2:30 PM 

Location of Event: Basecamp Coworking (4 Main St, Farmington, CT 06032)

Total Payment: Early Bird $55, Regular Price $65, T.R.I.B.E Members $15 off (hereinafter referred to as the “Payment”)

 

This Event Contract (hereinafter referred to as the “Contract”) for participation in The Sleeved Dietitian In-Person Fall Meet-Up (hereinafter referred to as the “Event”) releases The Sleeved Dietitian LLC (hereinafter known as the “Company”) a Limited Liability Company organized and existing under the laws of the State of U.S. STATE WHERE YOUR BUSINESS IS REGISTERED and each of its successors, assigns, administrators, contractors, subcontractors, directors, agents, officers, trustees, employees, staff, volunteers, other participants, advertisers and owners or lessors of the premises on which the Event occurs, as stated below.

 

Any individual who registers for and/or attends the Event (hereinafter referred to as the “Attendee”) agrees to the terms and conditions set forth herein. Together, the organising company (hereinafter referred to as the “Company”) and the Attendee are collectively referred to as the “Parties”.

 

The Parties hereby agree as follows:

 

  1. EVENT DESCRIPTION

The Event includes:

  • Access to our exclusive in-person gathering
  • Bariatric-friendly brunch snack bar (provided by Hungryroot)
  • Build-your-own proffee bar (powered by 1st Phorm)
  • Creative connection stations (including bracelet-making, vision boarding, and more)
  • A very special surprise announcement

The Event does not include:

  • Airfare or transportation to and from the Event location
  • Lodging or accommodation costs
  • Any meals, beverages, or activities not expressly listed above

 

  1. PAYMENT

The payment for the Event is as follows:

  • Early Bird Ticket: $55 (available until October 5)
  • Regular Ticket: $65 (purchased after October 5)
  • R.I.B.E. Member Discount: $15 off (discount code available through the membership portal)

Each Attendee must purchase one ticket per person. Tickets are valid for adults only.

All payments must be made in full at the time of registration via the designated payment method (e.g., credit card, PayPal, or other approved methods). Payments are non-refundable except as expressly provided in Section 7 (Cancellation).

 

  1. WAIVER AND RELEASE

By attending, traveling to or from, and/or participating in the Event in any capacity, the Attendee voluntarily agrees to release, waive, and forever discharge the Company, its owners, officers, employees, contractors, agents, representatives, and affiliates from any and all claims, actions, demands, liabilities, losses, injuries, damages, costs, or expenses of any kind, whether known or unknown, arising out of or related to the Attendee’s travel to/from, attendance at, or participation in the Event.

The Company shall not be held responsible or liable in any way for any damages, injuries, harm, illness, accidents, or losses incurred in connection with the Attendee’s participation. The Attendee acknowledges that participation is at their own risk.

The Company does not assume liability for damages, injuries, harm, death, or misuse of (or failure to properly use) information, materials, or resources provided during the Event, whether caused by the Attendee’s actions, omissions, or otherwise.

Notwithstanding anything to the contrary contained herein, the Attendee’s sole and exclusive remedy for any claim of negligence, breach, or failure to perform by the Company shall be limited to a refund of the ticket price paid. In no event shall the Company be liable for any indirect, incidental, special, or consequential damages.

 

  1. ASSUMPTION OF THE RISK

The Attendee understands and acknowledges that attendance at, participation in, and/or travel to or from the Event may involve inherent and unforeseen risks. These risks may result in tangible or intangible harm, including but not limited to accidents, illness, or injury.

It is solely the Attendee’s responsibility to familiarise themself with any and all potential risks associated with participation in the Event. The Attendee agrees that the Company shall not be held liable, to the fullest extent permitted by law, for any harm, damages, or losses the Attendee may experience arising out of or in connection with attendance at or travel to/from the Event.

THE ATTENDEE ACKNOWLEDGES THAT THEIR DECISION TO ATTEND THE EVENT IS MADE VOLUNTARILY AND WITH FULL KNOWLEDGE OF THE INFORMATION SET FORTH HEREIN. THE ATTENDEE AGREES TO BE THE SOLE RESPONSIBLE PARTY AND ASSUMES ALL RISKS ASSOCIATED WITH ATTENDING AND/OR TRAVELING TO/FROM THE EVENT. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY DAMAGES OR LIABILITIES ARISING FROM OR IN CONNECTION WITH THE ATTENDEE’S PARTICIPATION OR ATTENDANCE.

 

  1. INDEMNIFICATION, DEFENSE, & HOLD HARMLESS

The Attendee agrees to indemnify and hold harmless the Company, its affiliates, officers, directors,  agents, employees, representatives, successors, independent contractors, and assigns from all direct and third party claims, demands, losses, causes of action, damages, lawsuits, expenses, fees, including attorneys’ fees, costs, and judgments that may be asserted against the Company, by any third parties that result from the errors, negligence, acts, and/or omissions of the Attendee, other Attendees, Event venue, and/or the Company.

 

  1. DISCLAIMER

The Attendee understands that the Company is represented by Jamie Mills, a Registered Dietitian.

The Attendee further understands that the Company is not acting as a physician, psychotherapist, psychologist, or other licensed medical professional beyond the scope of dietetics. Therefore, the Attendee agrees that any information, suggestions, or guidance provided during the Event is for general educational and informational purposes only and shall not be considered a substitute for personalised medical advice, diagnosis, or treatment.

The Attendee agrees to consult with their own physician or qualified medical professional before making any changes to diet, exercise, supplements, medications, or lifestyle habits. The Company makes no representations or warranties regarding outcomes, and the Attendee acknowledges that individual results will vary.

Further, the Company has not promised, nor shall it be obligated to:

  1. Act as a therapist by providing psychological counselling, psychoanalysis, or behavioural therapy;
  2. Diagnose, treat, or manage any serious medical condition; or
  3. Provide medical supervision for any Attendee who is not under the care of their own physician or licensed healthcare provider.

 

 

  1. CANCELLATION + REFUND POLICY

The Company reserves the right to cancel the Event for any reason. In the event the Company cancels the Event, the Attendee shall be entitled to a refund of the ticket Payment made directly to the Company for services not yet rendered. The Company shall not be responsible or liable for any additional costs incurred by the Attendee, including but not limited to travel, lodging, or other third-party expenses.

Once the Attendee secures their Event ticket by completing the Payment, all sales are final and no refunds will be issued for any reason. Tickets are non-transferable unless expressly approved in writing by the Company.

 

 

  1. ARBITRATION

Any controversy or claim between the Parties shall be settled by arbitration before a single, mutually agreed-upon arbitrator under the then-current rules of the American Arbitration Association (“AAA”). If the Parties cannot agree upon an arbitrator, each Party shall appoint one arbitrator, and those two arbitrators shall appoint a third neutral arbitrator to hear the matter.

The decision and award of the arbitrator shall be final and binding, and the award so rendered may be entered in a state court of Connecticut. The arbitration hearing shall be held in the state of Connecticut.

Each Party shall be responsible for its own costs and expenses related to the arbitration, and the cost of the arbitrator shall be split equally between the Parties. The arbitrator shall have no authority to award punitive or other non-compensatory damages to either Party. No damages excluded by, or in excess of, any damage limitations set forth in this Contract shall be awarded. The Attendee’s sole remedy shall be limited to a refund of any amount paid directly to the Company.

 

  1. SEVERABILITY

The provisions of the Contract shall be deemed severable, and the invalidity or unenforceability of any provision shall not affect the validity and enforceability of any other provision hereof. If any Section, subsection, sentence, or clause of the Contract shall be adjudged illegal, invalid, or unenforceable, such illegality, invalidity, or unenforceability shall have no effect on the Contract as a whole or on any Section, subsection, sentence, or clause hereof not expressly so adjudged.

 

  1. WAIVER

The waiver or failure of the Company to exercise waiver in any respect, for any right provided herein, shall not be deemed  a waiver of any further right pursuant to the Contract.

 

  1. NO ASSIGNMENT

The Attendee’s Event ticket may not be assigned, transferred, or sold to any other individual without the prior express written consent of the Company.

Should the Attendee wish to transfer their ticket, they must first email [email protected] to confirm whether a waitlist or substitution option is available. The Company does not guarantee that the Attendee’s ticket can or will be transferred.

If the ticket is not successfully transferred and the substitute’s payment is not completed in full, the Attendee will not be entitled to a refund.

 

  1. FORCE MAJEURE

In the event that any circumstances beyond or not within the reasonable control of the Parties, including, but not limited to: an act of God (such as, but not limited to, fire, explosion, earthquake, flood, tsunami, drought, tidal waves, hurricanes, etc.), hostilities, war, invasion, curtailment or interruption of transport, threats or acts of terrorism, State Department travel advisory or warning, labor strike or civil disturbance, make it inadvisable, illegal, or impossible, either because of unreasonable increased costs or risk of injury, for either Party to perform its obligations under the Contract, the affected Party’s performance shall be extended without liability for the period of delay or inability to perform due to such circumstances.

 

  1. NO GUARANTEES, WARRANTIES OR REPRESENTATIONS

The Company has not and does not make any warranties, guarantees, or representations, verbally or in writing, regarding the Attendee’s experience, performance, results, income, revenue, or success with regards to attending the Event. The Attendee understands that due to the nature of the Event, the results experienced by each Attendee may vary. The Company does not make any guarantees other than that the Event shall be provided to the Attendee in accordance with the terms of the Contract as stated herein.

 

  1. APPLICABLE LAW + VENUE

This Contract shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law principles. Any action arising out of or related to this Contract shall be brought exclusively in the courts located in Hartford County, Connecticut.

 

  1. ENTIRE AGREEMENT & HEADINGS                       

The Contract contains the entire agreement between the Parties. There are no other promises or conditions in any other agreement (oral or written) between the Parties.

 

The headings of Sections in the Contract are provided for convenience only and shall not affect its interpretation or enforceability.

 

  1. PHOTOGRAPH AND IMAGE RELEASE

The Attendee hereby grants the Company permission to photograph, record, and otherwise capture their likeness, image, and/or voice in connection with attendance at the Event. The Attendee further grants the Company all rights, title, and interest in and to such photographs, audio, and/or video recordings for use in promoting, marketing, and advertising the Event or future events, including but not limited to use on social media, in advertisements, and on the Company’s website.

The Attendee acknowledges and agrees that they shall not receive any compensation for the use of their likeness, image, testimonial, or recording, and waive any right to inspect or approve the final product in which such likeness or recording may appear.

 

ATTENDEE STATEMENT:

By completing the ticket purchase for the Event, the Attendee acknowledges that they have read, understood, and agreed to be bound by all terms and conditions set forth in this Contract, including the Waiver and Release of Liability.

The Attendee affirms that they are at least 18 years of age and legally competent to enter into this agreement. The act of purchasing a ticket constitutes the Attendee’s voluntary and binding acceptance of these Terms, which shall serve as a complete and unconditional release of liability to the fullest extent permitted by law.
